Terms of Service

These terms are the agreement between you and RadioWyves Media about using TalkTo, an anonymous text chat for adults. They say who can use it, what you must not do, how we deal with trouble and where our responsibility ends.

1. Who we are and what the service is

TalkTo is run by RadioWyves Media, registered in South Africa. You can write to us at legal@talktohq.com or through the support form.

The service is the website at https://talktohq.com and everything on it. It lets adults talk in text and nothing else: no camera, no microphone, no photos. You can be paired with a random stranger for a one-to-one chat, read and join the public rooms that we run, add friends and send them private direct messages, play two-player games inside a one-to-one chat, and change the colour theme. We call all of that "the service".

By using the service, and by ticking the box on the start screen, you accept these terms, the Privacy Policy, the Cookie Policy and the Community Guidelines. If you do not accept them, please do not use the service.

2. Age and lawful use

Adults only. You must be 18 or older, or the age of adulthood where you live if that is higher. The start screen asks you to tick a box confirming your age. That tick is a statement you make to us, so only tick it if it is true.

If you are under 18, you may not use the service. If we find out, or have good reason to suspect it, we will end your access and may remove what you sent. Our filter blocks a message where a person declares themselves a minor, and that can set off a temporary ban while someone looks at the case. If you are a parent or guardian and you find a minor here, tell us through the support form.

Use the service only where the law lets you. Do not use it if sanctions or export rules that apply to you or to us bar you from receiving it, or if you are somewhere we cannot lawfully offer it. Do not use it to plan, carry out or help with a crime.

3. Your identity and your login

  • You do not need an account to start. You tell us Male, Female or Other, and we hand you a handle and an animal avatar. You cannot choose the handle.
  • An email address is optional. If you add one, you can log in on another device with a six-digit code that we email to you and that works for 15 minutes. There is no password. We never show your email address to other users.
  • Add only an email address that belongs to you.
  • Keep your login codes and your signed-in browser to yourself. We treat anything done from your account as done by you. If you think someone else has got in, log out and write to us.
  • The idea is one person, one account. Do not share your account, and do not open new ones to get round a ban or a block. We cannot see who is behind an account, so we cannot promise to catch every duplicate, but we may close the ones we find.

4. What you must not do

The Community Guidelines give examples. In short, you must not use the service to:

  • send, ask for or describe sexual content, anywhere, including the rooms marked 18+, which are for adult conversation and not for sexual content
  • post slurs or hate speech, or pick on people for who they are
  • harass, bully, stalk, threaten or frighten anyone
  • spam, advertise, run a scam or ask people for money
  • say or hint that you are under 18, or post anything that sexualises or endangers someone under 18
  • reveal another person's private details, such as a real name, address, workplace, phone number or email address, without their agreement
  • steer people to other apps, or trade links, email addresses, phone numbers or social handles
  • dodge a ban, a block or the message filter, whether with new accounts, spelling tricks or coded text
  • scrape, crawl or harvest data from the service, or run bots, scripts or auto-replies in place of a real person
  • pretend to be someone else, our staff included
  • probe the service for weak spots, overload it, or try to reach data that is not yours
  • do anything illegal, or help someone else to

None of this is allowed, and we act on it. Section 7 explains how.

5. The message filter

Every message passes through an automated filter on our server before anyone else receives it. That covers one-to-one chat, direct messages, rooms and notes.

The filter looks for sexual content, slurs, a person saying they are a minor, web links, email addresses, phone numbers, and attempts to take the conversation to another app or to trade social handles. A blocked message is not sent, and you are told why. Repeated blocked messages can lead to a temporary ban.

It is a filter and not a promise. It misses things, and now and then it blocks a harmless message. Do not count on it to keep you safe. Block and report instead. Trying to slip past it breaks these terms.

6. Your content and the permission you give us

"Your content" means anything you send through the service: messages, notes, reactions, game moves, reports and support messages.

You keep the rights you already have in it, and you are responsible for it. By sending it you promise that you are allowed to and that it follows these terms.

You give us a worldwide, free, non-exclusive permission to host, store, copy, process and display your content inside the service, as far as we need to in order to run it. In practice that means delivering a message to the people you sent it to, showing room messages as readable history, and keeping what a report needs. The permission lasts while your content exists on the service, plus any time we must keep a report or meet a legal duty. We do not use it to publish your words anywhere else.

Other users can screenshot or copy what you send, and we cannot stop them. Room messages can be read by other users, including people who have not joined that room.

One-to-one chats are not saved. The History screen lists recent conversations by handle, time and message count so you can report someone afterwards, but it does not keep the messages. We hold a short excerpt of your latest chat so that a report can include it, until your next chat replaces it. The Privacy Policy has the full list of what we keep and for how long.

7. Reporting, blocking and enforcement

You have two tools when someone spoils a conversation.

  • Report. Choose a reason: harassment, sexual content, looks under 18, hate speech, spam or scam, or other. The report carries a short excerpt of the chat and goes to a queue that a person reviews. Reporting someone you were matched with ends that chat.
  • Block. The person is never matched with you again, cannot message you, any shared chat ends, and you stop being friends.

We may warn you, remove content, limit what you can do, or ban you for a while or for good. Some temporary bans start automatically, for example when several people report you separately, when you keep sending blocked messages, or when you state in a message that you are a minor. A person then reviews the case. Longer bans are always a person's decision. We do not promise how fast a report will be looked at.

A ban covers the account and also the network connection it came from, which we keep only as a one-way hash. A fresh anonymous account on that same connection is therefore covered too. If you share a connection with someone who was banned, such as a shared flat or a café network, and you get caught by mistake, ask us to look again through the support form.

To appeal a ban or a removal, use the support form, give your handle and tell us what happened. A person will read it. We do not have to reverse a decision, but we will weigh what you tell us.

We may remove any content and act on any account when we think it is needed to keep people safe, protect the service or meet the law, even where the rules above do not fit the case neatly.

8. Safety between users

We cannot verify anyone. Handles are handed out at random, and everything else a person tells you may be untrue. The person you meet may not be who or what they say.

  • Keep personal details to yourself: full name, address, school, workplace, financial details, passwords and login codes.
  • Do not send money to anyone you meet here.
  • You are responsible for what you share and for what you choose to do because of what others tell you.
  • If someone makes you uneasy, stop replying, block them and report them.

If you or someone else is in danger, or you are in crisis, contact your local emergency services or a crisis line straight away. We do not watch chats for self-harm and cannot send help to you. More advice is on the Safety page.

9. Third-party services and sponsored slots

The service runs on outside providers: Cloudflare for hosting, the database and network security, Resend for login emails and Google Analytics for site statistics. Their own terms cover what they do, and we do not control them.

A sponsored slot can appear in places such as the direct message list. If you click one, you leave the service, and the other site's terms and privacy policy apply. We do not run those sites and we are not responsible for them, or for anything you buy or sign up for there.

10. Our property, the games and the themes

The name TalkTo, the logo, the design, the software, the text, the games and the themes belong to us or to people who license them to us. We give you a personal, revocable permission, which you cannot pass on, to use the service in the way it is meant to be used.

Do not copy, resell, reverse engineer or rebuild any part of the service, and do not use our name or logo without asking first.

The games, the leaderboard and the themes are part of the service. Unlocking a theme, keeping a streak or winning games gives you no property and no cash value. We may change, rebalance, reset or retire any of them. Cheating at a game, or faking a result, can get you removed.

11. Copyright complaints

If you think something on the service infringes your copyright, contact us at legal@talktohq.com and include:

  • your name and contact details
  • a description of the work you say was copied
  • where the material appears: the room, the rough time and the handle that sent it, since messages here have no public web addresses
  • a statement that you believe in good faith that the owner or the law does not allow the use
  • a statement that your notice is accurate and that you own the work or may act for the owner
  • your signature, which can be your full name typed out

We may remove the material and pass your notice to the person who posted it. People who infringe again and again lose access. Sending a notice that you know is false can make you liable for the harm it causes.

12. Disclaimers

The service comes "as is" and "as available". We do not promise that it will always be online, fast or free of faults. Maintenance, outages and problems at our providers happen.

We do not promise that you will be paired with anyone, that a room will be busy, or that a person you meet will be kind, honest or who they say they are. We do not check what users say and we do not endorse it.

Some places do not allow certain disclaimers. Where that is so, ours apply only as far as your local law lets them, and your legal rights stay in place.

13. Limits of liability and claims from misuse

As far as the law allows, RadioWyves Media, its owners, staff and providers are not liable for indirect or knock-on loss, lost profit, lost data or damage to reputation that comes from your use of the service. We are also not liable for what other users say or do, including anyone you meet through the service.

Where we are liable, our total liability for all claims together is limited to what you paid us for the service in the twelve months before the claim arose. Nothing here limits liability that the law does not let us limit, such as liability for fraud, or for death or personal injury caused by negligence.

Your part. If someone makes a claim against us because of your content, your breach of these terms or your unlawful use of the service, you will cover the reasonable costs and losses that claim causes us, legal fees included, as far as the law allows. We will tell you about the claim.

14. Ending your access

You can stop at any time. To remove your account, open Settings and delete it. That wipes the handle and what hangs off it (friends, direct messages, notes, history rows) and blanks the room messages you posted earlier. There is no way back. The Privacy Policy says what we keep afterwards.

We can suspend or end your access, and remove content, if you break these terms, if safety or the law calls for it, or if we change or close the service. We will explain where we can, but we do not have to warn you first.

When your access ends, the parts of these terms that are meant to outlast it stay in force: the permission for reports and records we must keep, the disclaimers, the limits of liability, your part in claims, and the rules on governing law.

15. Governing law and disputes

The laws of South Africa govern these terms and any dispute about them or about the service. Disputes will be heard in the courts of South Africa.

If you live somewhere whose consumer law gives you rights that a contract cannot remove, you keep those rights, including any right to go to a court in your own country. Before anything formal, please write to us first. Most problems can be sorted out with a conversation.

16. Changes and the small print

We may change these terms. The date at the top shows the latest version, and when a change matters we will post a notice on the service. If you keep using the service after a change takes effect, you accept the new version. If you do not agree, stop using the service and delete your account.

These terms, together with the policies they point to, are the whole agreement between you and us about the service. If one part turns out to be unenforceable, the rest stays in force. If we do not enforce a term straight away, we have not given it up. You may not transfer your rights under these terms. We may transfer ours to whoever takes over the service.
